Program Description:
This course discusses techniques mediators employ to help the parties "get to yes" and, more importantly, assist the parties in avoiding pitfalls in memorializing and enforcing agreements. Attendees will learn the steps needed to assist the parties and counsel in documenting the settlement and the expectations concerning who should perform those tasks. The panel will discuss standards employed in determining whether the parties reached an enforceable settlement. The panel will also discuss the mediator's role in assisting parties in memorializing the settlement. Designed for experienced mediators and seasoned dispute resolution professionals, the program will offer practical guidance on turning an end-of-day agreement into a durable resolution.
