Program Description:

The ICDR International Symposium on Advanced Case Management Issues is a mandatory one-day program for all neutrals seeking inclusion on the ICDR Roster. This highly interactive session is designed to deepen participants' expertise in managing complex international arbitration and mediation cases.

Led by Steve Andersen (DVP - Ed. Services), the symposium will provide valuable hands-on experience through a series of practical exercises that reflect real-world arbitration challenges. Throughout the day, participants will engage in discussions on a range of critical topics, including:

  • Preparing for the Preparatory Conference: Understanding how to set the stage for arbitration, manage initial disputes, and allow for procedural matters to be addressed early.
  • Managing Preparatory Conference Issues: A look at the key issues that arise during preparatory conferences, including discovery disputes, witness lists, and the scheduling of the case. This exercise will help arbitrators tackle these challenges effectively.
  • Managing Issues Between the Preparatory Conference & the Evidentiary Hearing: This session will address the common issues that emerge between the preparatory conference and hearings, focusing on resolving disputes and keeping the arbitration process on track.
  • Managing Evidentiary Hearing Concerns: With the use of video presentations and case discussions, this exercise will cover how to effectively manage evidentiary challenges during hearings.
  • Panel Dynamics: A critical session on the challenges of working with three-member, party-appointed arbitration panels, and how arbitrators can navigate potential conflicts and differences of opinion.
  • Managing Post-Hearing, Award, and Post-Award Issues: This final exercise explores what happens after the hearing ends, covering topics such as the timing of post-hearing briefs, managing costs, and addressing any post-award disputes.

Each of these exercises is designed to provide practical tools and strategies for dealing with the most pressing case management issues in international arbitration and mediation. The program’s interactive nature allows participants to share experiences and learn from leading neutrals, improving their ability to handle high-stakes, complex cases.

By the end of the day, participants will have gained actionable insights and enhanced their ability to effectively manage every stage of an arbitration and/or mediation, from the preparatory conference to the post-hearing phase. This program offers unparalleled value for anyone looking to sharpen their case management skills and stay ahead of emerging trends in the field.
