Program Description:
This course will teach mediators strategies to employ before and during mediation to help parties achieve binding and enforceable mediated settlement agreements. We will explore ways for mediators to proactively collaborate with counsel before mediation, and guide counsel and parties during mediation, toward a definitive resolution of the dispute. We will address risks inherent in leaving mediation with a signed term sheet (instead of a settlement agreement), and we will identify and discuss key provisions that will maximize the enforceability of a term sheet.
Some of the questions we will explore include:
- What makes a mediated term sheet enforceable?
- What consideration should mediators give to collateral documents?
- What role can a mediator play in resolving disputes over mediated term sheets?
- And how do confidentiality requirements factor into court enforcement of settlement agreements?
- Where relevant, we will address significant case law, statutes, and rules governing mediators.
This 90-minute course will include a lecture and dynamic interactive activities, e.g., small group discussion, hypotheticals, and worksheets. A handout with sample forms and materials will be provided.
