Program Description:

Bias—whether conscious or unconscious—can influence neutrals and advocates in subtle but significant ways. This program provides an in-depth look at how blind spots affect decision-making, party perceptions of fairness, and access to justice in mediation and arbitration. Using recent scholarship, real-world examples, and interactive scenarios, faculty will highlight approaches to identifying implicit bias, designing more inclusive processes, and fulfilling professional obligations to promote fairness and impartiality in ADR.
