Program Description:
Most insurance policies that include arbitration clauses call for disputes under the policy to be decided by a panel of three arbitrators, often through language such as: “Each party shall select an arbitrator, and the chosen arbitrators shall select a third arbitrator, who will chair the panel.” Frequently, however, the process of selecting the panel chair is time-consuming and contentious. Negotiations between the insurance company’s and policyholder’s appointees can take weeks, with disagreement and delay often the norm rather than the exception. AAA Rules give the party appointed arbitrators 14 calendar days to complete the selection before the AAA will make that appointment. This program will examine the challenges that arise in selecting a panel chair, the implications for parties on both sides of the dispute, and practical strategies for navigating or avoiding stalemates.
