Program Description:

Arbitration is designed to be more efficient and cost effective than court litigation. Subject to the provisions in the parties’ arbitration agreement, and the rules of the applicable arbitral forum, discovery in arbitration is more focused and limited than discovery in court proceedings. Nevertheless, discovery is often essential to properly prepare the arbitration for hearing. This Webinar will examine rules, cases, and statutes applicable to discovery in arbitration (including third party discovery), best practices for conducting discovery and resolving discovery disputes, and the impact of ESI and AI on the discovery process.

The faculty will discuss:

1) How an arbitrator determines the appropriate scope of discovery.
2) Discovery issues to address at the preliminary hearing.
3) Issues surrounding privacy and confidentiality.
4) Third party discovery under the FAA and under applicable state arbitration statutes.
5) Best practices for resolving discovery disputes in arbitration.
6) E-discovery protocols and the impact of AI on the conduct of discovery in arbitration, and the resolution of discovery disputes.
