Whether given orally at the close of a hearing or in writing as a post-hearing brief, the primary function of the closing argument is to make it as easy as possible for the arbitrator to reach a favorable determination. The goal of a brief is to persuade, not to argue. Every brief should conclude with a statement telling the arbitrator exactly what you want done in the case; what are the facts; what are the issues in dispute; why should the arbitrator rule in your favor; and, what are you asking the arbitrator to do?
