The “just cause” standard is included in almost every collective bargaining agreement, and yet the concept is not well understood. An experienced AAA® arbitrator and two skilled labor practitioners begin the program with their insights into the theory and application of just cause and their views on the “seven tests,” along with: • The general ground rules in a discipline case, Then, using redacted cases, attendees will split into virtual groups, each led by one of the speakers, to defend one side or the other. The leaders will guide the attendees to discuss their thoughts on issues in discharge cases pertaining to off-duty misconduct, sexual or racial harassment.
