Mediation is not litigation. It is the polar opposite of adversarial as a process and offers the opportunity for resolution based on collaboration, common ground, and a willingness among the parties to uncover mutual interests. And while the rules for mediation are far less prescribed than those for arbitration or litigation, achieving greater success in mediation requires unique preparation on the part of advocates. Lack of preparedness by counsel almost guarantees that the mediation will not end well. 

During this 60-minute recorded webinar, you will learn how to prepare more effectively for mediation so as to create an environment where the parties are most likely to see the mediation end with a mutually satisfactory resolution.  Areas covered include—

  • deciding whether to mediate, including how the mediator can be useful in facilitating settlement and identifying whether your case is a good candidate for mediation;
  • deciding when to mediate;
  • selecting a mediator – characteristics to consider, mediation approach or style, and where to find a mediator;
  • preparing yourself to mediate (e.g., what you should know about your own case and the other side’s case; settlement options to consider; who should attend the mediation; planning the mediation);
  • preparing the mediator (using a pre-mediation memorandum; what to avoid);
  • preparing the client for mediation.
